These Terms & Conditions (“Terms”) govern your use of this website and your dealings with Viattori Watches, an Ontario sole proprietorship registered under the Business Names Act (“Viattori,” “we,” “us”), based in Oakville, Ontario, Canada. We provide private, appointment-only service and do not operate a public storefront. By using this site you accept the website terms in these Terms. Terms specific to a transaction, such as a service, restoration, or purchase engagement, apply when you enter that transaction through the written documents described in Section 1, not merely by browsing this site. You must be at least 18 years old to transact with us. Our Privacy Policy explains how we handle personal information. If these Terms conflict with a signed estimate, invoice, or bill of sale, the signed document controls for that transaction.
1. Our Services and How Transactions Work
This website is informational. Online checkout, payment, and shipping are not yet available: the site processes no payments and completes no sales. Watches shown, described, or priced on the site are an invitation to inquire, not a binding offer to sell; pieces in the Showcase section are not offered for sale at all. No transaction is formed until both parties accept written transaction documents, an invoice, or another explicit written agreement. All engagements, whether repair, restoration, or the sale of one of Viattori’s own editions, are concluded off the site in that way. Viattori does not currently buy watches, take consignments, or sell pre-owned watches.
If we later enable online purchases or shipping, these Terms, the Privacy Policy, and the applicable shipping, returns, disclosure, and checkout acceptance processes will be reviewed and updated before any purchase can be completed on the site.
2. Intellectual Property and Brand Names
Viattori and its licensors own all content on this site, including text, photography, logos, and design. You may view the site for personal, non-commercial purposes; you may not copy, scrape, or reuse its content, including listing photographs and descriptions, for commercial purposes.
Viattori is an independent atelier. We are not an authorized dealer or service center of, and are not affiliated with, endorsed by, or sponsored by, any watch manufacturer. All third-party brand names and logos appearing on this site, including those of the manufacturers whose watches we service, are trademarks of their respective owners and are used solely to identify the watches we service. Manufacturer warranties on watches we service may be void or non-transferable; the warranties that apply are our own, described in Section 7 and Section 11.
3. Contact Form and Communications
Information you submit through our contact form must be accurate. You may not impersonate anyone, submit fraudulent inquiries, or inquire about goods you know to be stolen or counterfeit. By submitting the form, you consent to our contacting you by email or phone about your inquiry. Personal information in your submission is handled under our Privacy Policy. Feedback, suggestions, and ideas you choose to send us are non-confidential, and we may use them without restriction or compensation; your personal information remains governed by the Privacy Policy.
4. Acceptable Use
You agree not to:
- use the site for any unlawful purpose, fraud, or misrepresentation;
- scrape, harvest, or systematically copy site content, or use our photographs and descriptions to advertise goods elsewhere;
- interfere with the site’s operation, introduce malware, or attempt unauthorized access;
- frame or mirror the site without our written consent.
We may decline any inquiry or transaction at our discretion, consistent with applicable law.
5. Listings, Descriptions, and Pricing
Watches we offer, including our own editions, are sold in the condition described. We prepare condition descriptions and photographs in good faith, and photographs are of the actual watch offered, but screen rendering of color and finish varies. Boxes and papers are included only when listed.
Prices are in Canadian dollars unless stated otherwise. Prices and availability may change without notice, and a watch may be sold, withdrawn, or placed on hold at any time before we issue written confirmation. Despite our care, typographical or technical errors in pricing or descriptions may occur; we may correct errors and refuse or cancel any transaction arising from one, and if you have already paid we will refund the full amount. To the extent applicable law permits, that refund is the remedy for such an error. Any commentary on market values is opinion, not an appraisal, a valuation guarantee, or investment advice.
6. Orders, Payment, and Title
No purchase is binding until we issue a written confirmation or invoice and your payment has cleared in full. Accepted payment methods and any deposit terms are stated on the invoice. We may verify identity, payment, and shipping details, and may refuse or cancel a transaction for suspected fraud, failed verification, sanctions or export restrictions, or pricing errors. Title passes to you on receipt of full cleared payment. Sales, use, and import taxes and duties are your responsibility except where we must collect them.
7. Authenticity Guarantee
Every watch that leaves our bench, whether one of our own editions or a customer’s watch returned from service, goes out with its serial and case numbers, movement details, and detailed photographs on record. For our own editions we guarantee that the watch is as described in its documents: built by Viattori, with the movement, case, and dial stated there. This guarantee covers that exact watch, verified against those records.
Claims are reviewed case by case. If you believe an edition we sold you is not as described, contact us at concierge@viattoriwatches.com with the written opinion of a qualified independent watchmaker, and return the watch to us for physical inspection. Once our inspection confirms that the returned piece is the watch we sold, matching the serial numbers and identifying details recorded at the time of sale, we will refund the full purchase price. A returned watch that does not match our records is not the watch we sold, and this guarantee does not apply to it.
Our editions may be built around movements or components from other makers; where they are, we say so in the listing or invoice. This guarantee is Viattori’s own; it is not made by, and does not bind, any manufacturer. Should Viattori later offer pre-owned watches, this section will be updated before any such watch is offered.
8. Shipping, Delivery, and Risk of Loss
Shipping is not yet generally offered; watches currently change hands at private appointments. When we do arrange shipping, the following applies. We ship tracked, with adult signature required on delivery. Risk of loss passes to you on signed delivery. Inspect the package on arrival: refuse or note a damaged or tampered package with the carrier, and report any damage, loss, or discrepancy to us within 48 hours of delivery so carrier claims can be preserved. Shipping timeframes are estimates, and we are not liable for carrier or customs delays. International buyers are the importer of record and bear duties, taxes, and brokerage fees. Some destinations may be unavailable because of carrier or export restrictions, including wildlife regulations on exotic-material straps.
Sending a watch to us. Ship inbound watches using the shipping instructions or prepaid label we provide. Our responsibility for your watch begins on our signed receipt of it, or on tender to the carrier when you use our label. Follow the packing instructions we send, including double-boxing and omitting any indication of the contents from the outer packaging; photograph the watch and record its serial number before shipping.
9. Returns
Watches purchased from us may be returned within 7 days of delivery for a refund, provided the watch is unworn and unaltered, any protective seals and stickers are intact, and all boxes, papers, links, and accessories delivered with it are included. Request a return authorization from us at concierge@viattoriwatches.com before shipping; returns must use insured, signature-required shipping at your cost. We refund the purchase price to the original payment method within 10 business days of receiving and inspecting the return. Watches that have been sized, worn, or opened by anyone else are not returnable. If you are a consumer in a jurisdiction whose law grants a longer withdrawal or return right for distance sales, such as the EU or UK, that right applies as the law provides. Completed repair and restoration work is not returnable; service concerns are handled under the Limited Service Warranty.
10. Repairs and Restoration: Estimates and Authorization
No work begins until you approve a detailed written estimate. Assessment and estimates are free of charge. Approval by email or signature forms our service agreement. By sending us your watch, you authorize us to open and disassemble it as needed to assess it. Estimates are valid for 30 days. If disassembly reveals additional necessary work, we stop and obtain your approval of a revised estimate before proceeding; you may decline, and we will reassemble and return the watch, with return shipping at your cost.
You represent that you own the watch or are authorized to submit it for service. Replaced parts are returned to you on request at pickup, except parts that manufacturers supply only on an exchange basis; otherwise we discard them. Where original parts are out of production or restricted by the manufacturer, we may propose equivalent replacement parts in your estimate; using non-manufacturer parts can affect a watch’s value, and we disclose them before fitting. Opening the case may affect any remaining manufacturer warranty. For vintage pieces, parts may be obsolete or need to be sourced, timelines may extend, and a correctly restored vintage watch may not meet modern timekeeping or water-resistance standards. Completion dates are good-faith estimates, not guarantees.
11. Six-Month Limited Service Warranty
We warrant the workmanship of our service and the parts we installed within the approved scope of work for 6 months from the invoice date. If a covered defect appears in that period, we will re-examine the watch and correct the defect at no charge. This is a Limited Warranty, and re-repair is the remedy it provides; it is in addition to, and does not replace or limit, any right or remedy you have under applicable consumer protection or sale of goods law. To make a claim, contact us at concierge@viattoriwatches.com and use the shipping instructions we provide.
Watches we sell carry this same warranty: the movement and the service work we performed before sale are covered for 6 months from the day the watch is delivered to you. The warranty extends to the original customer and is not transferable. On a valid claim, you pay shipping to us using our instructions, and we pay the return shipping back to you. Warranty re-repairs typically take six to eight weeks, depending on parts availability.
This warranty does not cover:
- water or moisture damage. We pressure-test to specification at delivery, but we cannot guarantee water resistance after the watch leaves our care, and vintage watches are not warranted against moisture regardless of any markings or ratings on the watch itself;
- damage from shock, accident, abuse, negligence, or exposure to strong magnetic fields;
- damage or defects caused by opening, inspection, or work by anyone we did not authorize;
- wear items: straps, bracelets, crystals, crowns, stems, batteries, and other components that require periodic replacement, unless we replaced them during the service;
- components outside the approved scope of work;
- theft, loss, and consequential damage of any kind.
Any implied warranties or conditions, including merchantability and fitness for a particular purpose, are limited in duration to the 6-month period of this written warranty, to the extent applicable law permits. Some jurisdictions, including some Canadian provinces and US states, do not allow limitations on implied warranties or statutory conditions, or the exclusion or limitation of incidental or consequential damages, so these limitations may not apply to you. This warranty gives you specific legal rights, and you may have other rights that vary by province or state. This warranty is not conditioned on your using Viattori for any other service.
12. Your Watch in Our Care
We take reasonable care of every watch from the moment it arrives until it is back with you, and our responsibility for it is measured by its “agreed value”: the value you declare at intake and we confirm in writing, or, absent a declaration, our documented fair-market assessment. Declare value accurately and disclose known defects: sentimental value cannot be recovered, and undervaluation limits recovery to the declared amount. Watches in our care are not covered by an insurance policy; if you want your watch insured while it is with us, arrange that under your own policy.
We document each watch’s condition on receipt. We are not responsible for pre-existing damage, or for deterioration inherent to the piece, such as radium-burned dials or brittle vintage components, that manifests during normal, careful handling. If a watch is lost, stolen, or damaged while in our care through our failure to take reasonable care of it, we will repair it, replace it like for like, or pay up to the agreed value; to the extent applicable law permits, that is the remedy for such loss. Keep proof of ownership; we may require identification, we refuse items we suspect are stolen, and if a watch matches a stolen-watch register we will notify law enforcement and cooperate with them, including holding the watch where they require. We decline to service counterfeit watches and return them at the sender’s cost.
13. Consignment
Viattori does not currently buy watches or take consignments. Should that change, each consignment will be governed by a separate signed Consignment Agreement, and these Terms will be updated before any consignment is accepted.
14. Uncollected Property
Collect your watch, or accept our return shipment, within 60 days of our notice that work is complete or that an estimate was declined. Keep your contact details current; we send written notices to the email and address you provide. After the 60-day period, reasonable storage fees of $2 per day accrue. We hold a lien on serviced items for unpaid charges to the extent Ontario’s Repair and Storage Liens Act allows. If a watch remains uncollected for six months despite at least three attempts to reach you, we may dispose of it only as that Act permits; proceeds are applied to charges owed, storage, and costs of sale, and any surplus is handled as that law requires.
15. Website Disclaimer
The website and its content are provided “as is” and “as available,” without warranties of accuracy, completeness, availability, or uninterrupted operation. Site content is general information, not an appraisal of your property, insurance advice, or investment advice. Nothing in this section limits the express warranties in Sections 7, 11, and 12 or any warranty that cannot lawfully be disclaimed.
The site links to third-party platforms, currently Instagram and WhatsApp, for convenience. We do not control them and are not responsible for their content, terms, or policies; your use of them is governed by their own terms. Content we post on social channels is informational and subject to these same disclaimers.
16. Limitation of Liability
To the extent permitted by law, Viattori is not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, loss of use, and sentimental value. Our total liability is capped: for claims about the website itself, at $100; for a watch you purchased, at the price you paid; and for a watch in our care, at its agreed value under Section 12. Nothing in these Terms limits liability for gross negligence, willful misconduct, or fraud, or any liability that applicable law does not allow to be limited. Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so parts of this section may not apply to you.
Nothing in these Terms excludes a condition or warranty that Canadian provincial consumer protection or sale of goods law implies into a consumer transaction and does not allow to be excluded.
17. Indemnification
To the extent permitted by applicable law, you will indemnify Viattori against third-party claims arising from your breach of these Terms, misuse of the site, violation of law or third-party rights, false statements about the ownership, title, or authenticity of a watch you bring to us, or inaccurate declared values or descriptions. We control the defense of any such claim, with your reasonable cooperation.
18. Governing Law and Disputes
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in it, without regard to conflict-of-laws rules, and disputes are subject to the jurisdiction of the courts of Ontario. If you are a consumer in a jurisdiction whose law grants you mandatory rights, including rights about where and how you may bring a claim, nothing here reduces them. Before filing any claim, write to us at concierge@viattoriwatches.com describing the dispute; both sides will negotiate in good faith for 30 days. Claims are subject to the limitation periods established by applicable law.
19. Changes to These Terms
We may revise these Terms. Revisions take effect when posted here with an updated effective date, and we flag material changes with a notice on the site. Continued use of the site after changes take effect constitutes acceptance. Changes do not apply retroactively: sales and services already concluded remain governed by the terms in effect when they were made, together with their signed documents.
20. General Provisions
If a provision of these Terms is found invalid, it will be reformed or severed and the rest remain in effect. Our not enforcing a provision is not a waiver of it. We may assign these Terms, for example in a sale of the business; you may not. We may suspend or end your access to the site if you breach these Terms. Neither party is liable for delay or failure caused by events beyond reasonable control, including carrier disruptions, customs holds, and manufacturer parts embargoes. These Terms, the Privacy Policy, and the signed documents for your transaction are the entire agreement; where they conflict, the signed documents control for that transaction. Sections 7, 11, 12, and 15 through 18 survive the end of any engagement. Nothing in these Terms restricts your right to post honest reviews of our services.
